“STORY PIRATES/SECRET LIFE OF PETS 2 – WHAT DOES YOUR PET DO WHEN YOU’RE NOT HOME” CONTEST“

OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. 

THE “STORY PIRATES/SECRET LIFE OF PETS 2 – WHAT DOES YOUR PET DO WHEN YOU’RE NOT HOME” CONTEST (the “Contest”) starts with the acceptance of Contest entries (as detailed below) at 10:00 a.m. Eastern Time (“ET”) on 8/14/19 and entry in the Contest ends at 12:00 p.m. (ET) on 9/10/19 (“Entry Period”).  The Contest consists of (1) the Entry Period and (2) Judging, as detailed below. 

The sponsors of this Contest are Universal Pictures Home Entertainment, 10 Universal City Plaza, Universal City, CA 91608 (“UPHE”) and Striking Viking Story Pirates LLC, 21 West 39th Street, New York, NY 10018 (collectively, the “Sponsors”). The Contest shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein.   

 

CONTEST ENTRIES THAT DO NOT MEET THE REQUIREMENTS SPECIFIED BELOW WILL BE DISQUALIFIED AND WILL NOT BE JUDGED. 

 

ELIGIBILITY: CONTEST IS OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND DISTRICT OF COLUMBIA (COLLECTIVELY THE “ELIGIBILITY AREA”) WHO ARE (1) EIGHTEEN (18) YEARS OF AGE OR OLDER AND (2) THE PARENT OR LEGAL GUARDIAN OF A STUDENT BETWEEN THE AGES OF FOUR (4) AND EIGHTEEN (18) WHO IS REGISTERED AT A GOVERNMENT-ACCREDITED PUBLIC OR PRIVATE SCHOOL WITHIN THE ELIGIBILITY AREA AS OF THE DATE OF THEIR ENTRY AND PRIZE AWARDIMG.  Employees and their families (defined as parent, child, sibling and spouses) of the Sponsors, Gimlet Media, West Coast Marketing, a division of the Susquehanna Hat Company (“West Coast Marketing”), their respective affiliates, subsidiaries, parent companies, judges and agencies (collectively, the “Contest Entities”) and those living in the household of same (whether related or not) are not eligible to enter or win.  By participating in the Contest, entrants agree to abide by all terms and conditions of these Official Rules.  The laws of the United States apply to and govern this Contest and any claims must be raised and resolved in the federal or state courts located in Los Angeles County, California, United States. All federal, state and local rules and regulations apply. Void in Puerto Rico, all U.S. territories and possessions, and where prohibited or restricted by law.   

HOW TO ENTER THE CONTEST: During the Entry Period, you may enter the Contest via the Internet by doing the following: 

(1) going to the “STORY PIRATES/SECRET LIFE OF PETS 2 – WHAT DOES YOUR PET DO WHEN YOU’RE NOT HOME” CONTEST page at  storypirates.com/secretlife (the “Contest Site”);

(2) providing your child’s or legal ward’s first and last name that created the Story (defined below) who may be referred to hereafter as the “Author” of the Story, the Story title and; entering your child’s or legal ward’s unique short story (“Story”) in which (in the space provided), they tell their own Story of what their pet (real or imagined) does when they aren’t home;

(3) optionally uploading a photograph or video to assist with the Story;

(4) providing the name of the Author’s school and the grade of author when Story was written;

(5) completing your personal contact information as directed, providing your first name, last name, street address, city, state, zip code, email address, age and daytime telephone number; and (6) click “Submit”.   

By completing the foregoing and agreeing to the Official Rules you will automatically receive one (1) entry into the Contest subject to the terms of these Official Rules (the provision of the submitted Story and personal information collectively referred to as a “Contest Entry”).  ONLY ONE (1) CONTEST ENTRY WILL BE ACCEPTED FROM ANY ONE (1) INDIVIDUAL.

All Stories submitted to the Contest Site may (at Sponsors’ sole discretion) be available for viewing by the public on the Contest Site or any other web site(s) determined at the sole discretion of the Sponsors.  The entrant understands, acknowledges and agrees that Sponsors are under no obligation whatsoever to continue to display on the Contest Site or any other web site, any Contest Entry previously posted, and/or otherwise to use the Contest Entry as permitted pursuant to these Official Rules. 

In addition to any other requirements set forth in these Official Rules, in order to be deemed eligible for participation, each Contest Entry and/or the entrant submitting it must meet the following conditions and restrictions:

-     The Story submitted must be created by the child or legal ward of the individual submitting the Story and be in English and in the words of the child or legal ward. 

-      The Story must not defame or invade the publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights or that constitute copyright infringement. 

-      The Story must be totally original and not in any identifiable way (at sole discretion of Sponsors) be inspired by, include or be recognizable as including characters and/or plots or themes from movies, television or books.

-       The Story must not contain any content that is sexually explicit, sexually suggestive, offensive, illegal, pornographic or obscene or that is in bad taste or is otherwise       objectionable to Sponsors, as determined by Sponsors in their sole and exclusive discretion.

-       The Story must not contain any recognizable third party logos or marks or other commercial or advertising content other than those of Sponsors, their respective affiliates or their respective products or services.

-       The Story must not disparage Contest Entities or any other person or entity.

-       The Story must not contain material that promotes bigotry, racism, hatred or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age or is otherwise objectionable to Sponsors, as determined by Sponsors in their sole and exclusive discretion.

-       The Contest Entry must not contain corrupted files, viruses, or any other similar software files, the intent of which is to damage the operation of another’s computer.

ALL CONTEST ENTRIES MUST BE RECEIVED DURING THE CONTEST ENTRY PERIOD.

CONTEST WINNER DETERMINATION:  All eligible Contest Entries will be judged according to the below set of judging criteria (“Judging Criteria”) with specific weight assigned to each criterion displayed in the Story:

1) Creativity 50% (50 points)

2) Originality – 50% (50 points)

All judging will be done by a panel of qualified judges chosen by Sponsors in accordance with the Judging Criteria and judging is scheduled to be completed on/about 9/14/19. The maximum number of points available to be awarded to each entrant is one-hundred (100) points.  Contest Entries that do not achieve a total of a minimum of seventy-five (75) points will not be considered for the prize. 

The highest scoring entrant (in the opinion of the judges) from among all respective eligible entrants who score a minimum of seventy-five points will be declared the potential contest winner in the Contest.  In the case of a tie, the potential contest winner will be determined from such tied Contest Entries on the basis of the Contest Entry’s rank in the first criterion, continuing in descending order thereafter to the second criterion, as needed to break the tie.

If at the end of the above stated tie-breaking procedures, a tie remains, judges will re-score the tied eligible Contest Entries until the tie is broken. If a potential contest winner is found to be ineligible or does not otherwise comply with these Official Rules, such potential contest winner will be disqualified, and the entrant with the next highest eligible score, if any, will be declared the potential contest winner. The new selectee (and his/her Contest Entry) will also have to comply with all the terms and conditions of these Official Rules and the Terms and Conditions (including, without limitation, all eligibility requirements) to be deemed the potential contest winner. SPONSORS MAY, IN THEIR SOLE DISCRETION, DECLARE THAT THERE IS NOT A WINNER OF THE CONTEST IF NO ELIGIBLE CONTEST ENTRIES ARE RECEIVED.

Sponsors in their sole discretion shall determine if any Contest Entry is inappropriate for any reason for public release including but not limited to publication on the Contest Site.  Sponsors shall have the right to disqualify any Contest Entries that they deem to not meet the criteria, or due to technical, legal, clearance or other problems, or which it deems to be obscene, pornographic, demeaning or otherwise not in good taste, as determined by Sponsors in their sole discretion.   Prize winner may be required (at Sponsors’ sole discretion) to provide proof that the winning Story was created by the child or legal ward of the prize winner. Failure to comply with this requirement may (in Sponsors’ sole discretion) result in forfeiture of the prize and an alternate prize winner determined per the above judging process. Sponsors’ and judges’ decisions are final and binding with respect to all matters relating to this Contest.

The potential contest winner will be notified within three (3) days of the completion of the judging process detailed above, and the potential contest winner will be required to execute and return an Affidavit of Eligibility/Release of Liability, completed IRS W-9 form (if requested), and (except where prohibited by law) a Publicity Release form within five (5) business days.  In addition the potential contest winner will be required to have a “Prize Acceptance and Release of Liability” form executed by an authorized representative of the School (defined below) and returned within this same deadline. Non-compliance with these Official Rules or failure to return all required documents within the deadline may result in the forfeiture of the prize. Once all required paperwork is received from the potential contest winner and all terms of these Official Rules have been complied with, such potential contest winner shall be declared the “Contest Winner”. The Affidavit of Eligibility/ Release of Liability will include the Contest Winner’s consent (and as parent or legal guardian of Author, Author’s consent as well) to grant Sponsors a royalty-free, irrevocable, perpetual, non-exclusive, worldwide, unrestricted and transferable license to use, edit, alter, copy, reproduce, modify, disclose, publish, remove, create derivative works from, distribute, exhibit, display or otherwise exploit the Story in whole or in part, and to incorporate it into other works, in any form, media or technology now known or later developed, for any purpose whatsoever including, without limitation, for advertising, Contest or publicity purposes without any additional compensation or notification to the Winner.

CONTEST PRIZE: The Contest prize  consists of a “Private Performance” (“Performance”) of the prize winning Story donated and performed at the Author’s school (“School”) by Story Pirate actors for the Contest Winner, Author and guests which may include other students and teachers at the School, other parents, etc. (individually a “Guest” and collectively “Guests”) on a date and time determined at the sole discretion of the Sponsors and School plus the Story will be adapted for a special bonus episode of the Story Pirates podcast. The approximate retail value of the donated prize is $3,000.  Once the Performance date is determined, no change, extension, or substitution is permitted, except by Sponsors at their sole discretion. 

All transportation to and from the Performance and any other expenses not specified herein are the sole responsibility of the Contest Winner and his or her Performance Guests.  Releasees (defined below) are not responsible for any changes in scheduling of Performance. Schedule permitting, the performance may be replaced with a recorded show.  

Contest Winner must be able to attend the Performance on date and time and location to be determined by Sponsors in their sole discretion or prize will be forfeited and an alternate may, at Sponsors’ sole discretion be determined. Sponsors and their designees may eject any attendee of the Performance displaying obnoxious or any other inappropriate behavior (as determined by Sponsors or their designee) from Performance at any time.

An unclaimed and/or unused prize will remain the property of Sponsors or their designee. 

Acceptance of the prize constitutes permission (except where prohibited by law) for Sponsors and their designees to use the  Contest Winner’s name, address (city and state), likeness, voice, statements, Contest Entry, Story (and any edited version thereof) and any other personal characteristics for any purpose, including without limitation advertising, Contest and publicity purposes worldwide in perpetuity, in any medium or format now known or hereafter created, without additional compensation, notification, permission or limitation, and such Winner hereby releases Sponsors and their respective designees from any liability with respect to such use.    

The Contest Site clock shall be the official timekeeper of the Contest.

The Contest Entities, their respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively the “Releasees”) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions or availability of the site during maintenance; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest; inability to access the Contest Site; inability to submit Story or required personal information and/or; theft, tampering, destruction, or unauthorized access to, or alteration of Contest Entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site; printing or other errors; late, lost, stolen, mutilated, misdirected or postage-due mail or any combination thereof.  Proof of submitting a Contest Entry is not considered proof of delivery or receipt.  Illegible, incomplete and duplicate Contest Entries will be disqualified.  No Contest Entries will be returned or acknowledged.  False and/or deceptive Contest Entries or acts shall render entrants ineligible.  By registering to enter the Contest, entrant affirms that they have read and accepted these Official Rules.  Any information collected by registering to enter the Contest or participate in the Contest shall be used only in a manner consistent with these Official Rules and with the Story Pirate Privacy Policy, which can be found at the Contest Site. Any information provided by Contest Winner will be subject to the UPHE Privacy Policy available at https://www.nbcuniversal.com/privacy.

LIMITATIONS ON LIABILITY: Releasees shall not be liable to the Contest Winner or any other person for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Releasees’ sole control.                                              

By participating in this Contest, entrants agree that Releasees shall not be liable for personal injuries, death, dismemberment, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Contest, or from acceptance of or use or inability to use a prize or parts thereof, including without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, dismemberment, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.  Contest prize winner: (a) releases the Releasees from any and all liability and responsibility with respect to a prize (including any property loss, damage, personal injury or death); and (b) acknowledges the aforementioned individuals and entities have neither made nor are in any manner responsible for any warranty, representation or guarantee, expressed or implied, in fact or in law, related to the prize.

GENERAL: If for any reason this Contest is not capable of running as planned, or if this Contest or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Contest and processing of Contest Entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsors’ sole opinion, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsors reserve the right, in Sponsors’ sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify or suspend this Contest or any portion thereof.  In the event the Contest is cancelled before the scheduled conclusion of the Contest or any portion thereof, Sponsors reserve the right to proceed to judge the eligible Contest Entries received (as detailed above) prior to the time of the action or event warranting such cancellation and award the prize.  If any such cancellation, termination, modification or suspension occurs, notification will be posted at the Contest Site.  ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE (INCLUDING THE CONTEST SITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 

NOTE: Entry must be made by the entrant, only at the Contest Site. Contest Entries made by any other individual or any entity, and/or originating at any other Internet web site or email address, including but not limited to commercial contest subscription notification and/or entering service sites, will be declared invalid and disqualified for this Contest.  The use of any device, computer program or software to automate the entry process is prohibited.
