Every Great Adventure Begins With A Spark Contest ("Contest") starts on October 25, 2018. All entries must be received by 11:59 p.m. Eastern Time (“ET”) on November 8, 2018.
ELIGIBILITY: Contest is open to individuals who are legal residents of the fifty (50) United States and District of Columbia, 18 years of age or older, who are the parents or legal guardians of a child between the ages of 6 - 12. Employees of Striking Viking Story Pirates LLC (“Sponsor”), Penguin Random House (“Publisher”), and their respective parents, affiliates, divisions, imprints, subsidiaries, advertising agencies, promotion fulfillment agencies and judging agencies, and their immediate families (spouse and parents, children and siblings and their respective spouses, regardless of where they reside) and household members, whether or not related, are not eligible. Void where prohibited by law. Contest is subject to all applicable federal, state and local laws. For the purposes of this Contest, the parent and not the child will be deemed the “entrant” and, if applicable, the “winner”. Prizes will be awarded to the parent of the child who submits the winning idea (as described more completely below), unless otherwise specified.
HOW TO ENTER: Visit www.storypirates.com/spark and follow the directions to complete and submit the entry form, including your child’s answers to the story questions (collectively, with entry form, “Entry”). Entries must be received by 11:59 p.m. ET November 8, 2018 to be considered. Limit one (1) Entry per child. You can only submit an Entry on behalf of your own child or legal ward. Entries received on behalf of any child in excess of the stated limitation will be void. All Entries become the sole property of the Sponsor and will not be returned.
Entry (i) must be child’s own original work, (ii) must be in English, (iii) cannot be previously published or submitted in connection with any other contest, (iv) must be in keeping with the Sponsor’s image and (v) must not be offensive or inappropriate, as determined by the Sponsor in its sole discretion, nor can it defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights. Sponsor reserves the right to disqualify any Entry that it determines, in its sole discretion, is offensive or inappropriate, not in keeping with Sponsor’s image, was not written by the child or that is otherwise not in compliance with these Official Rules.
JUDGING: All eligible Entries received by Sponsor will be judged by a panel of qualified judges based on the following equally-weighted criteria: originality, creativity and audience appeal. The Entry with the highest score, as determined by Sponsor in its sole discretion, will be deemed the potential winner. In the event of a tie, an additional, “tie-breaking” judge will determine the winner based on the criteria listed herein. Sponsor reserves the right not to award the prize if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries. Prize award is subject to verification of eligibility and compliance with these Official Rules. Judges’ and Sponsor’s decisions are final and binding on all matters relating to this Contest. Judging scores will not be revealed.
WINNER NOTIFICATION: Potential winner will be notified by telephone, mail and/or email and required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law), which must be returned within seven (7) days of date appearing on prize notification. Return of prize or prize notification as undeliverable, failure to sign and return requested documentation within the specified time period, the inability of Sponsor to contact a potential winner within a reasonable time period or noncompliance with these Official Rules by the potential winner will result in disqualification and, at Sponsor’s sole discretion, the prize may be awarded to a runner-up.
PRIZE: Winner will receive a $500 check and ten (10) copies of the Story Pirates book in which the story will appear (“Book”). The winner’s child will receive a credit in the Book and a Story Pirates Skype performance at his/her school. Exact details of performance, including date and length, will be determined by Sponsor, in its sole discretion. Schedule permitting, the performance may be replaced with a recorded show. If, for whatever reason, the Story Pirates are unable to perform at the child’s school or the Book is not published, no compensation or substitution will be provided for applicable prize component; however, remainder of prize package will be awarded and Sponsor will have no further obligation. Approximate Retail Value (“ARV”) is up to $1500. Winner may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value. Winner is responsible for all applicable federal, state and local taxes as well as any costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion.
USE OF ENTRIES: All Entries: By submitting an Entry, each entrant (on behalf of entrant and his/her child) grants Sponsor and its designees a perpetual worldwide irrevocable license in any and all media to exploit, edit, modify, and distribute the Entry, and all elements of such Entry, including, the child’s first and last name and city and state of residence, for advertising, promotion, trade and other purposes, in any and all media, now or hereafter devised (including Sponsor’s website and/or social media pages), in any manner, in whole or in part, together with other materials including, without compensation or notification to, or permission from, entrant or any third party. Winning Entry: Winner (on behalf of winner and his/her child) agrees to execute any necessary documents to transfer all right, title and interest in the Entry to Sponsor. Winning Entry may only be used as inspiration and not as exactly submitted. In addition, Sponsor may decide to only use part or portions of winning Entry. Winner understands that neither winner nor his/her child will have approval over how the Entry is presented in the Book. Winner understands that neither the winner nor his/her child will receive any compensation from the sale of the Book.
Entrants (on behalf of entrant and his/her child) understand and acknowledge that (i) Sponsor has wide access to ideas and that new ideas are constantly being submitted to Sponsor, including in connection with this Contest, or being developed by its own employees; ii) the Entry submitted by entrant as part of this Contest may be similar to, or identical to, other Entries; and iii) neither entrant nor his/her child will not be entitled to any compensation as a result of Sponsor’s selection or use of the Entry or any such similar or identical idea. Entrant (on behalf of entrant and his/her child) agrees that Sponsor shall not have any liability to entrant or his/her child for any direct, indirect, contributory, vicarious, secondary or other infringement or protection of any copyright in or to entrant’s Entry.
PUBLICITY GRANT: Each entrant (on behalf of entrant and his/her child) agrees to the use by Sponsor and its designees of his/her name, his/her child’s name and/or likeness, city and state of residence and Entry for advertising, promotional and other purposes, in any manner, in any and all media, now or hereafter known, worldwide in perpetuity, without further compensation or notification to, or permission from, entrant or his/her child, unless prohibited by law.
GENERAL CONDITIONS: By participating, each entrant (on behalf of entrant and his/her child) agrees: (a) to abide by these Official Rules and decisions of Sponsor and judges, which shall be final and binding in all respects relating to this Contest; and (b) to release, discharge and hold harmless Sponsor, Publisher, and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Contest or any Contest-related activity or the acceptance, possession, use or misuse of the awarded prize.
Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, illegible, stolen, delayed, misdirected, undelivered, or garbled Entries or mail; or for errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of Entries, the announcement of the prize, or in any Contest-related materials. Persons who tamper with or abuse any aspect of the Contest, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, select the potential winner from all eligible, non-suspect Entries received prior to action taken using the judging procedure outlined above. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
